Binding Agreement
By engaging Falcon Agency or subscribing to our operational programs, you consent to be legally bound by these Terms of Service. If you object to any portion of these provisions, you should immediately cease using our platform and solutions. Throughout this document, "Falcon Agency," "we," "us," or "our" refers to the agency and its authorized operators, while "You," "Client," or "Partner" refers to the business entity entering into this agreement.
Operational Scope & Ecosystems
Falcon Agency architects custom digital assets, automated communication channels, and active lead acquisition frameworks designed to elevate your company's market presence. Rather than focusing on simple tasks, we prioritize the overall operational growth experience. The specific features, assets, and deployment schedules are governed exclusively by your selected service plan.
Client Accountabilities
To keep your acquisition systems operating at peak velocity, you agree to fulfill the following obligations:
- Provide transparent, complete, and updated operational information regarding your enterprise.
- Supply your brand media, design elements, and image files promptly when requested.
- Grant necessary access keys, including your domain manager, active hosting portals, and required digital integrations.
- Review project milestones and deliver structural feedback within a reasonable timeframe.
- Confirm that all company-supplied content is entirely free from third-party copyright violations.
- Conduct your business and manage your customer communications in full compliance with local and international laws.
Project Schedules & Dynamic Refinements
We target specific launch windows for your digital assets based on your selected service tier. Final deployment dates rely heavily on how quickly your team provides feedback and required brand media. Each tier includes a dedicated number of structural revision loops. Requests that fundamentally alter the project scope or call for custom feature additions beyond the initial scope will require a tier adjustment. No asset goes live to the public until you provide written sign-off.
Multi-Country Billing & Recurring Subscriptions
Our solutions are delivered through an ongoing, recurring subscription model. By activating your plan, you authorize Falcon Agency to automatically process charges against your designated payment method at the start of each billing interval.
- Because our operations bridge multiple countries, all currency configurations, localized taxation adjustments, and billing rules adapt to the specific country where the client's business resides.
- All service memberships renew automatically unless a cancellation request is filed before the next billing date.
- Failed financial transactions will trigger an immediate update notice. Unresolved payment delinquencies may result in the prompt suspension of hosting, live lead streams, and active campaign channels.
Termination Protocols
You retain the right to terminate your subscription at any time. Your cancellation request will take effect on the final day of your current, active billing cycle.
- Your web pages and automation systems will remain functional for the remainder of the paid interval.
- Once that period ends, public web hosting, security patches, and pipeline access are turned off.
- Falcon Agency operates on closed, high-performance infrastructure; we do not provide downloadable source files or export site configurations to external hosting environments. Sustained digital visibility requires an ongoing, non-delinquent subscription.
Refund Restrictions
Because we instantly allocate specialized software engineering, strategic setups, and custom automation architecture upon onboarding, all transactional fees and recurring subscription payments are strictly non-refundable except where mandated by local consumer protection laws.
Intellectual Property & System Licensing
- Your Brand Elements: You retain full ownership of all text, logo graphics, trademarks, and media assets you send to us. You grant Falcon Agency a restricted license to handle these assets solely to configure and run your growth systems.
- Platform Availability: Your digital assets are managed and secured inside Falcon Agency's optimized cloud environment. Your access to these live interfaces depends entirely on keeping your subscription active.
- Proprietary Technology: Falcon Agency retains exclusive ownership, copyright titles, and intellectual property rights over all backend frameworks, system code libraries, layout engines, custom CSS/JS adjustments, and workflow patterns used to build your platform. These tools are licensed exclusively for your active deployment and cannot be extracted, copied, or sold for use elsewhere.
Operational Disclaimers
- While we build high-converting conversion paths and optimized digital setups, Falcon Agency offers its systems on a best-effort basis and explicitly disclaims guarantees regarding:
- Absolute search engine positioning or localized map pin placements.
- Fixed quantities of incoming telephone calls, web leads, or customer bookings.
Uninterrupted or permanent uptime on external servers.
Boundary of Liability
To the fullest extent permitted by applicable law, Falcon Agency and its staff shall not be liable for any indirect, circumstantial, or consequential financial losses, including drop-offs in corporate profits, lost operational data, or missed commercial opportunities. Our maximum financial liability for any dispute or performance issue arising from these Terms shall never exceed the exact cash amount you paid to Falcon Agency over the three (3) months immediately preceding the claim.
Revisions to These Terms
We reserve the right to modify these Terms of Service as technology and global regulations evolve. We will communicate important updates via your registered email address or prominently display them on our main site. Continuing to use our platforms and marketing systems after updates take effect means you accept the revised terms.
Digital Accessibility Compliance
Falcon Agency builds all digital infrastructure following contemporary web formatting standards. However, we cannot guarantee that your front-facing assets will achieve or maintain full compliance with the Americans with Disabilities Act (ADA), WCAG criteria, or regional accessibility mandates. The Client assumes all responsibility for verifying that their public platforms satisfy the specific regulatory laws of their business sector and operating country.
